These Terms and Conditions ("Terms") apply when you use goaiify.com (the "Site"), request a free audit, book a call, use our chat, or sign up to receive text messages or emails from AIify ("AIify," "we," "us," or "our"). By using the Site or any of these features, you agree to these Terms. If you don't agree, please don't use the Site.

Our Privacy Policy explains how we collect and use your information and is part of these Terms.

Who can use the Site

You must be at least 18 years old to use the Site's forms, chat, or text-message features. If you use the Site for a business, you confirm that you're authorized to act for that business.

Our services and client agreements

The Site describes the marketing services AIify offers, including websites, Google Business Profile management, review generation, follow-up automation, advertising, and content. Nothing on the Site is a binding offer or contract.

If you become a client, the specific services, pricing, minimum term, payment terms, and responsibilities will be set out in a separate written service agreement or proposal. If that agreement conflicts with these Terms, the agreement controls.

Free audits and consultations

Our free audits and consultations come with no obligation to buy anything. Any recommendations we give are based on the information available to us at the time, are for general guidance, and are not a promise of any particular result.

No guarantee of results

Marketing results depend on many things we don't control, including your market, competition, pricing, service quality, reviews, budget, seasonality, and the rules and algorithms of platforms like Google and Meta. We do not guarantee any specific number of leads, calls, jobs, rankings, reviews, or revenue.

Any figures, examples, or results shown on the Site are for illustration only unless we clearly say otherwise, and they are not a promise that you'll see the same outcome. Advertising budget ranges on the Site are general guidance, and ad spend is paid to the ad platforms, separate from any fees paid to AIify.

Third-party platforms

Our services rely on third-party platforms such as Google, Meta (Facebook and Instagram), and HighLevel. Those platforms have their own terms and policies, which can change at any time. We're not responsible for their decisions, including ad rejections, account restrictions or suspensions, ranking changes, review removals, pricing changes, or outages.

AI-assisted work

We use artificial intelligence tools to help draft content, ads, and automated messages, and our Site may include an AI chat assistant. Our team reviews client-facing work, but AI-generated responses in the Site chat are automated and may not always be accurate or complete. Chat responses are not professional advice and do not create a contract. For anything important, confirm directly with our team at [email protected].

Text message terms

Program. AIify sends text messages about your inquiry, including appointment confirmations and reminders, follow-ups on your audit request, and replies to your questions. If you call us and we miss your call, we may send one text in reply.

Consent. You agree to receive texts from AIify when you provide your phone number and check the text-message consent box on one of our forms, or when you text us first. Agreeing to receive texts is not a condition of buying any service.

Frequency and cost. Message frequency varies. Message and data rates may apply, according to your mobile plan.

Opting out. Reply STOP at any time to stop receiving texts. You'll receive one final message confirming you've been unsubscribed. To start again, reply START.

Help. Reply HELP for help, or email [email protected].

Carriers. Mobile carriers are not liable for delayed or undelivered messages.

Privacy. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. See our Privacy Policy for details.

Email

If you give us your email address, we may send you information about your inquiry and our services. You can unsubscribe from marketing emails at any time using the link in each email.

Using the Site

When you use the Site, you agree not to:

- Submit false information or information about someone else without their permission

- Use the Site, forms, or chat to send spam, harassment, or unlawful content

- Try to disrupt, hack, or overload the Site or its systems

- Scrape, copy, or collect content or data from the Site using automated tools

- Use the Site for any unlawful purpose

We may block access to the Site or its features for anyone who violates these Terms.

Our content

The Site and its content, including text, graphics, logos, designs, and the AIify name, belong to AIify or our licensors and are protected by intellectual property laws. You may view and share pages from the Site for personal or internal business use, but you may not copy, modify, or republish our content for commercial purposes without our written permission.

Ownership of work we create for clients, such as websites, ads, and content, is covered in each client's service agreement.

Links to other websites

The Site may link to websites or services we don't operate. We don't control them and aren't responsible for their content, policies, or practices.

Disclaimer

The Site and everything on it are provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the Site will always be available, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, AIify and its owners, team members, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Site, our free audits, chat, or messages.

Our total liability for any claim related to the Site or these Terms is limited to $100. This section does not limit liability that cannot be limited under applicable law, and it does not apply to services provided under a separate client agreement, which has its own terms.

Indemnification

You agree to hold AIify harmless from claims, losses, and expenses, including reasonable attorneys' fees, that arise from your misuse of the Site or your violation of these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. If a dispute comes up, please contact us first at [email protected] so we can try to resolve it informally. If we can't resolve it within 30 days, either of us may bring a claim in the state or federal courts located in Colorado, and you and we agree to those courts' jurisdiction.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll post the updated version on this page and change the effective date at the top. Your continued use of the Site after changes are posted means you accept the updated Terms.

General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms and our Privacy Policy are the entire agreement between you and AIify about your use of the Site.
